Preparing documents is more useful than memorizing a “magic phrase.” This chapter addresses operations subject to U.S. federal commercial vehicle rules; California inspections may also involve state requirements and officer instructions. Sources consulted: October 13, 2026.
Practical steps: Ask whether the driver or vehicle is out of service, what restrictions apply and what happens next. Send the complete report promptly to your carrier’s safety contact. If a citation was also issued, record its separate instructions and deadlines. Repairs, report certification and a citation are separate matters; “the office will handle it” does not confirm completion.
Official requirements: A vehicle placed out of service cannot resume operation until the repairs required by the notice are completed. Changing drivers does not clear a vehicle order. Under 49 CFR 396.9, deliver the report at the next carrier facility; transmit it immediately if you are not scheduled to reach one within 24 hours. Also provide the report to the intermodal equipment provider when applicable. Within 15 days, the carrier must certify correction and, if required by the issuing state agency, return the completed report. This is not a grace period to drive an out-of-service vehicle. 49 CFR 396.9
Useful phrase: “Does this report place the driver or the vehicle out of service? What must happen before we can leave?” “这份报告是否要求司机或车辆停运?离开前必须完成什么?”
The checklists and phrases are teaching examples. No forum claim is used as an enforcement rule. Refer a specific dispute to the carrier’s responsible person or an appropriate professional.
