California Non-Domiciled CDL Restrictions: Responding to a Cancellation Notice
A California CDL cancellation notice can affect driving privileges before the date printed on the card. Check the notice’s effective date against your current DMV record. If cancellation has taken effect, stop driving and coordinate work arrangements with your employer.
As checked on September 21, 2026, California continues to pause non-domiciled CLP and CDL issuance for limited-term legal-presence applicants, including renewals, replacements, corrections, upgrades and transfers. DMV’s March 6 announcement said licenses unaffected by that cancellation action remained valid until expiration. Check for subsequent actions or other restrictions.
For drivers covered by DMV’s cancellation guidance, noncommercial Class C privileges are also cancelled. Eligible drivers must obtain valid noncommercial privileges before driving a regular car. The DMV guidance page provides application and appointment links. Bring your notices, identity and residency documents, and surrender your existing license as directed. New non-domiciled CDL applications remain on hold; DMV has not announced when issuance will resume.
Under 49 CFR § 383.33, employees receiving notice of cancellation or other covered loss of driving privileges must notify their current employer before the end of the following business day. Keep a record of that notification.
The federal rule effective March 16, 2026 generally limits the foreign-domiciled application pathway to qualifying H-2A, H-2B or E-2 status, with required documentation and verification. An employment authorization document alone does not meet these requirements. Meeting federal criteria does not reopen California issuance. State-domiciled U.S. citizens and lawful permanent residents may qualify for standard CDLs.
Employers should review current records through applicable EPN procedures and verify license class, endorsements and restrictions before assigning driving. Under 49 CFR § 383.37, employers must not knowingly, or when they should reasonably know, use drivers lacking appropriate valid credentials. Pending applications do not restore driving authority. Confirm discrepancies with DMV and seek qualified advice for individual legal or immigration questions.
